Special Committee for International Coordination

The Subcommittee has appointed members to the AASHTO Special Committee for International Activity Coordination. This committee studies practices of other countries to discover new trends in management, operations, and technology being developed in these countries relative to transportation. Gerry Gallinger, Director, Real Estate Services, Washington State Department of Transportation, and Gary Fawver, Division Chief, Right of Way and Utilities, Pennsylvania Dept. of Transportation represent the AASHTO Right of Way Subcommittee on the special committee. Lyle McMillan, Chief of Right of Way, Utah Dept. of Transportation serves as an alternate member.

International Right of Way and Utilities European Scan Team

The Subcommittee, in conjunction with F.H.W.A. completed a scanning tour of four European nations as part of the Transportation Research Board's National Cooperative Highway Research Program Panel 20-36, during May 2002 for the Joint AASHTO/FHWA FY 2000/20001 Biennial Scanning Program, titled European Right of Way and Utilities Best Practices, to develop an understanding and awareness of other country’s successful Right of Way and Utilities practices that could result in faster project delivery and greater customer satisfaction or to increase technological advancement.

Following the completion of the Scan Tour, a final report was prepared dated August 2003 which was published on FHWA's website at the following website address:

The report includes recommendations to transportation agencies in conducting their Right of Way and Utilities activities.Because of the wide national disparity in state laws relating to Right of Way acquisition, condemnation, contracting and Utilities, many of the recommendations for best practices included were not considered to be organizationally feasible or were not permitted under the law in some states. However, an Implementation Team was established to consider implementation of findings and recommendations.

International Scan Implementation Team

The Subcommittee is participating with F.H.W.A. in the International Scan Implementation Team. This team is responsible for developing implementation strategies for the best practices discovered during the European Right of Way and Utilities Scan.Pilot projects have been approved by F.H.W.A. in several states to test these innovative practices:

• Appraisal Waiver Pilots (Florida, North Carolina, South Carolina)

• Appraisal Review Modification (Florida, Michigan, Wisconsin, and Washington);

• Acquisition Incentive Offer Pilot (Florida)

• Single Agent Appraiser/Negotiate Pilot (California)

• Relocation Incentive Offer Payment (Virginia)

Development of Right of Way Core Curriculum at Community Colleges

The International Scan Tour also found that in Europe Right of Way trainees could study Right of Way in universities. F.H.W.A. and the International Scan Implementation Team are attempting to encourage development of distance learning programs on core Right of Way curriculum at the university level. To date, Delaware Technical and Community College and the Community College of Baltimore County (Catonsville) have developed and offered such courses on site.
